Windrush

Commonwealth citizens, like the Windrush generation, are a unique group who have built their life here and have contributed enormously to our country. I do not want anyone to be in any doubt about their right to remain here.  

When these people came to the UK they were deemed to be settled in the UK under our legislation at the time. This meant some did not obtain nor need documentation to prove their right to be here. While the vast majority who came before 1973 will now have documentation that proves their right to be in the UK, there have recently been some cases where people have not obtained the necessary documentation and have struggled to access public services.  

This issue has come to light because of measures introduced in recent years to make sure only those with a legal right to live here can access things like NHS treatment and rented accommodation. This has resulted in some people now needing to evidence their immigration status to access certain services.  

To ensure this can happen as easily and smoothly as possible, the Home Office has set up a new dedicated team to help those people evidence their right to be here. The team will help applicants demonstrate they are entitled to live in the UK, have a dedicated contact point, and will be tasked with resolving cases within two weeks of when the evidence has been provided. In addition, no one affected will be charged for the documentation which proves their right to be here.

The Government recognises some of these people may struggle to evidence when they arrived and how long they have been in the UK, so this dedicated team will work across government to help people provide the evidence they need. Any information they can provide, from schools they attended to places of work will help build this picture. The Home Office is already engaging with charities and High Commissions to ensure people are made aware of this new service.

I understand that the report by the independent adviser, Wendy Williams, has not yet been submitted to Ministers. I have been assured that once it is available, the Home Secretary will publish her report. I am sure you agree in the importance of the Wendy Williams report being free of political interference.

Mae dinasyddion y Gymanwlad, fel cenhedlaeth Windrush, yn grŵp unigryw o bobl sydd wedi adeiladu eu bywyd yma ac wedi cyfrannu’n aruthrol at ein gwlad.  Nid wyf am i neb amau eu hawl i aros yma.  

Pan ddaeth y bobl hyn i’r DU, ystyriwyd eu bod wedi ymgartrefu yn y DU o dan ein deddfwriaeth ar y pryd. Roedd hyn yn golygu nad oedd angen dogfennaeth ar rai ohonynt i brofi eu hawl i fod yma. Er y bydd gan y mwyafrif helaeth o bobl a ddaeth yma cyn 1973 ddogfennau erbyn hyn sy’n profi eu hawl i fod yn y DU, mae rhai achosion wedi bod yn ddiweddar lle mae pobl wedi methu â chael gafael ar y dogfennau angenrheidiol ac wedyn wedi cael trafferth cael mynediad at wasanaethau cyhoeddus.

Mae’r mater hwn wedi dod i’r amlwg oherwydd y mesurau a gyflwynwyd yn ystod y blynyddoedd diwethaf i sicrhau mai dim ond y rheini sydd â hawl gyfreithiol i fyw yma all gael mynediad at bethau fel triniaeth o dan y GIG a llety rhent. Mae hyn yn golygu bod angen i rai pobl nawr ddangos tystiolaeth o’u statws mewnfudo er mwyn cael mynediad at rai gwasanaethau.  

Er mwyn sicrhau bod hyn yn gallu digwydd mor hawdd a didrafferth â phosibl, mae’r Swyddfa Gartref wedi creu tîm newydd i helpu’r bobl hynny i brofi bod ganddynt hawl i fod yma. Bydd y tîm yn helpu ymgeiswyr i ddangos bod ganddynt hawl i fyw yn y DU, bydd yn cynnig pwynt cyswllt penodol ac yn gyfrifol am ddatrys achosion o fewn pythefnos i’r adeg y darperir y dystiolaeth.  Yn ogystal â hyn, ni chodir tâl ar unrhyw un am y dogfennau sy’n profi eu hawl i fod yma.

Mae’r Llywodraeth yn cydnabod y gall rhai o’r bobl hyn ei chael hi’n anodd profi pryd wnaethant gyrraedd ac am ba hyd maent wedi bod yn y DU, felly bydd y tîm penodol hwn yn gweithio ar draws y llywodraeth i helpu pobl i ddarparu’r dystiolaeth sydd ei hangen arnynt. Bydd unrhyw wybodaeth y gallant ei darparu, o’r ysgolion a fynychwyd ganddynt i’w gweithleoedd, yn helpu i greu’r darlun hwn. Mae’r Swyddfa Gartref eisoes yn ymgysylltu ag elusennau ac Uchel Gomisiynau i sicrhau bod pobl yn ymwybodol o’r gwasanaeth newydd hwn. 

Rwyf ar ddeall nad yw’r adroddiad gan y cynghorydd annibynnol, Wendy Williams, wedi cael ei gyflwyno i Weinidogion eto. Mae’r Ysgrifennydd Cartref wedi fy sicrhau y bydd yn cyhoeddi ei hadroddiad unwaith y bydd ar gael.  Rwy’n siŵr eich bod yn cytuno ei bod hi’n bwysig nad yw adroddiad Wendy Williams yn cynnwys unrhyw ymyrraeth wleidyddol.
