A vibrant, open and free press that can hold the powerful to account is vital to our democracy. Balanced against this it is not unreasonable to expect the press to act with understanding in relation to sensitive personal stories. Press freedom comes with a responsibility to ensure it is not abused.
However, those who court fame and publicity must realise that whilst it brings promotion and favourable comment, the press has a reputation for building people up only to tear them down. Both narratives sell newspapers and attract advertisers. Regulation is in place to ensure it does not get out of hand.
I am pleased that following the publication of the Leveson Inquiry in 2012, we have seen great improvements in press regulation with the formation of the Independent Press Standards Organisation (IPSO) and Impress, which have the power to hold publications to account, including ordering prominent corrections. Both regulators are independent of government and enforce Codes of Practice, which include provisions on privacy and intrusion. They both operate free complaints handling systems and low cost arbitration schemes.
Around 95 per cent of national newspapers are now overseen by IPSO. Members of IPSO are required to follow the Editors’ Code, which requires journalists to respect people’s right to privacy, stop approaches when asked to do so and to ensure reports are accurate.
I know that some feel the Government should intervene to limit the press in the interests of personal privacy, but I am satisfied that there has been sufficient progress made since 2012 that this is not necessary. I am assured that in cases relating to privacy, the individuals affected are able to complain to IPSO who will investigate vigorously and sanction the publication in question if appropriate.
IPSO’s Editors’ Code of Practice states clearly that the press should avoid making discriminatory references to an individual's race, colour, religion, sex, gender identity, sexual orientation, physical and mental illness or disability. In general, complaints can only be taken forward from the party directly affected, because it might involve sensitive information about that person, or it might not be able to be investigated properly without their input. In certain cases, where there is sufficient public interest, IPSO can also take complaints from representative groups affected by an alleged breach.

Yn sgil cyhoeddi Ymchwiliad Leveson yn 2012, rwy’n falch ein bod wedi gweld gwelliannau mawr yn y gwaith o reoleiddio’r wasg drwy greu Sefydliad Annibynnol Safonau’r Wasg (IPSO) ac Impress, sydd â’r pŵer i ddwyn cyhoeddiadau i gyfrif, yn cynnwys gorchymyn cywiriadau amlwg. Mae’r ddau reoleiddiwr yn annibynnol ar y llywodraeth ac yn gorfodi Codau Ymarfer, sy’n cynnwys darpariaethau ar breifatrwydd ac ymyrraeth. Mae gan y ddau systemau ar waith i ddelio â chwynion am ddim a chynlluniau cyflafareddu cost isel.
Mae tua 95 y cant o bapurau newydd cenedlaethol bellach yn cael eu goruchwylio gan IPSO. Mae’n ofynnol i aelodau o IPSO ddilyn y Cod Ymarfer i Olygyddion, sy’n mynnu bod yn rhaid i newyddiadurwyr barchu hawl pobl i breifatrwydd, peidio â mynd at bobl pan ofynnir iddynt roi’r gorau iddi a sicrhau bod adroddiadau’n gywir.
Gwn fod rhai pobl yn teimlo y dylai’r Llywodraeth ymyrryd i gyfyngu ar y wasg er budd preifatrwydd personol, ond rwy’n fodlon bod digon o gynnydd wedi bod ers 2012 nad oes angen gwneud hynny. Rwy’n fodlon, mewn achosion sy’n ymwneud â phreifatrwydd, y gall yr unigolion dan sylw gwyno i IPSO a fydd wedyn yn ymchwilio’n drwyadl ac yn cosbi’r cyhoeddiad dan sylw os yw’n briodol.
Mae Cod Ymarfer i Olygyddion IPSO yn nodi’n glir y dylai’r wasg osgoi cyfeirio mewn modd gwahaniaethol at hil, lliw, crefydd, rhyw, hunaniaeth rywiol, cyfeiriadedd rhywiol, salwch corfforol, salwch meddwl neu anabledd unigolyn. Yn gyffredinol, dim ond cwynion gan y bobl yr effeithir arnynt yn uniongyrchol y gellir bwrw ymlaen â nhw, oherwydd gallent olygu bod gwybodaeth sensitif yn cael ei defnyddio am y person hwnnw, neu efallai na ellir ymchwilio i’r cwynion yn gywir heb eu mewnbwn. Mewn rhai achosion, lle mae digon o fudd i’r cyhoedd, gall IPSO hefyd dderbyn cwynion gan grwpiau cynrychioliadol y mae achos honedig o dorri’r cod wedi effeithio arnynt.
